These Terms & Conditions apply to all courses, training programmes, events and related services provided by Venture Beyond (“we”, “us”, “our”).

By booking a course or training programme with us, you agree to these Terms & Conditions.

1. About Venture Beyond

Venture Beyond provides professional training and development courses for individuals and organisations, including training in first aid, health and safety, psychological safety, hostile environment awareness, leadership and specialist subjects.

Details of individual courses, including course content, location, duration, prerequisites, accreditation and price, will be provided on the relevant course page or at the time of booking.

2. Booking a Course

A booking becomes confirmed once:

  • you have completed the required booking information; and
  • we have received payment in full, unless an alternative payment arrangement has been agreed with us in writing.

A booking is made for the individual named on the booking unless we have agreed otherwise.

Places on courses are limited and are allocated on a first-come, first-served basis unless otherwise stated.

We reserve the right to refuse a booking where a participant does not meet the stated prerequisites or where we reasonably consider that the course is unsuitable for that participant.

3. Course Information

We make reasonable efforts to ensure that course descriptions, dates, locations, prices and other information published on our website are accurate.

However, we reserve the right to make reasonable changes to:

  • course content;
  • instructors;
  • course location;
  • timings;
  • equipment;
  • activities; or
  • other arrangements,

where necessary for operational, safety, accreditation or other legitimate reasons.

Where a change is significant, we will notify affected participants as soon as reasonably practicable.

4. Course Prerequisites

Some courses may have minimum age requirements, previous experience, qualifications, fitness requirements, medical considerations, language requirements or other prerequisites.

It is the participant’s responsibility to check the requirements for their chosen course before booking.

If a participant attends a course without meeting a stated prerequisite, we may prevent them from participating where this is necessary for safety, accreditation or other legitimate reasons.

Where a participant is unable to participate because they failed to meet a clearly stated prerequisite that applied to the course, we may not be able to provide a refund.

5. Participant Responsibilities

Participants must:

  • follow reasonable instructions given by Venture Beyond instructors and staff;
  • behave responsibly and respectfully towards instructors and other participants;
  • comply with relevant health and safety requirements;
  • use equipment appropriately;
  • disclose information that is reasonably necessary for us to assess their ability to safely participate;
  • inform us before the course of any relevant medical, physical or other condition that could affect their participation; and
  • comply with any specific requirements communicated before or during the course.

We reserve the right to remove a participant from a course where their behaviour presents a safety risk, significantly disrupts the course, or places another participant, instructor or member of the public at risk.

In such circumstances, no refund will normally be provided.

6. Health, Fitness and Medical Conditions

Certain Venture Beyond courses may involve physical activity, outdoor activity, simulated emergency situations, challenging environments or other activities carrying an inherent risk of injury.

Participants must only participate where they consider themselves capable of safely doing so.

Where a course requires specific medical or fitness information, participants must provide accurate information before attending.

Venture Beyond may request additional information or medical confirmation where reasonably necessary to determine whether participation is appropriate.

Nothing in these Terms & Conditions requires a participant to undertake an activity that an appropriately qualified instructor considers unsafe.

7. Risk and Safety

Some Venture Beyond training is designed specifically to replicate challenging, demanding or potentially hazardous environments.

Participants acknowledge that certain activities may carry inherent risks, including but not limited to:

  • slips, trips and falls;
  • physical exertion;
  • adverse weather;
  • outdoor environments;
  • use of training equipment;
  • simulated emergency situations;
  • travel or movement between training areas; and
  • risks associated with the particular course being undertaken.

We will take reasonable steps to provide a safe training environment and competent instruction.

Participants must follow all safety instructions given by Venture Beyond instructors.

Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation.

8. Course Cancellation by Venture Beyond

We reserve the right to cancel or postpone a course where this is reasonably necessary, including because of:

  • insufficient bookings;
  • instructor availability;
  • illness;
  • adverse weather;
  • venue problems;
  • equipment failure;
  • safety concerns;
  • government restrictions;
  • accreditation or regulatory requirements; or
  • circumstances beyond our reasonable control.

Where we cancel a course, participants will normally be offered either:

  • a transfer to an alternative date; or
  • a full refund of the course fee paid to Venture Beyond.

Where a course is postponed, we will provide reasonable notice wherever possible and will offer an alternative date.

Our liability for cancellation of a course is limited to the course fees paid to Venture Beyond, except where liability cannot legally be limited.

We are not responsible for additional costs incurred by participants, such as travel, accommodation or other expenses, unless otherwise required by law.

We strongly recommend that participants consider appropriate travel and cancellation insurance where significant additional costs are involved.

9. Participant Cancellation

If you need to cancel your booking, please contact us as soon as possible using the contact details provided on our website or booking confirmation.

Our refund policy is set out in our separate Refund & Cancellation Policy, which forms part of these Terms & Conditions.

Where appropriate, we may allow a participant to transfer their booking to another person or another course date, subject to availability and any applicable conditions.

10. Transfers and Substitutions

If you are unable to attend a course, you may request:

  • a transfer to another available course date; or
  • a substitution of another suitable participant.

Requests should be made as early as possible.

Any replacement participant must satisfy all relevant course prerequisites.

We reserve the right to charge a reasonable administration fee where a transfer or substitution creates additional administrative or third-party costs.

11. Course Certificates and Accreditation

Where a course leads to a certificate or recognised qualification, certification is subject to the participant meeting the relevant course, assessment and accreditation requirements.

Attendance alone does not guarantee successful completion or certification.

Where certification is provided by an external awarding or accrediting organisation, that organisation’s rules and requirements may also apply.

Venture Beyond cannot guarantee that a participant will pass an assessment or obtain certification.

12. Prices and Payment

Course prices are displayed on the Venture Beyond website or otherwise confirmed before booking.

Unless stated otherwise, the price shown at the time of booking is the price payable for the course.

Payment must be made in accordance with the booking instructions.

We reserve the right to correct genuine pricing or administrative errors. If an error results in an incorrect price being displayed, we will contact you before processing the booking where reasonably possible.

13. Group and Corporate Bookings

Additional terms may apply to group, corporate or private bookings.

These may include agreed minimum numbers, bespoke course content, venue arrangements, instructor requirements, deposits and cancellation arrangements.

Where specific written terms have been agreed for a group booking, those terms will take precedence over these Terms & Conditions to the extent of any inconsistency.

14. Intellectual Property

All course materials, presentations, documents, photographs, videos, graphics, training resources and other materials supplied by Venture Beyond remain the property of Venture Beyond or the relevant rights holder unless otherwise stated.

Course materials are provided for the personal or internal use of the participant or organisation that purchased them.

They must not be copied, reproduced, distributed, commercially exploited, published or supplied to third parties without our prior written permission.

15. Photography and Filming

Venture Beyond may occasionally take photographs or video footage during training for legitimate business, training or promotional purposes.

Where identifiable participants are intended to appear in promotional material, we will seek appropriate consent where required.

Participants should inform an instructor before the course if they do not wish to be included in promotional photography or filming.

16. Personal Belongings

Participants are responsible for their own personal belongings during a course.

Venture Beyond is not responsible for loss, theft or damage to personal property except where caused by our negligence or where liability cannot legally be excluded.

17. Complaints

We want participants to have a positive experience.

If you have a complaint about a course or service, please contact us as soon as possible so that we have an opportunity to investigate and resolve the matter.

Complaints should be made in writing where possible and should include sufficient information for us to investigate the issue.

We will consider complaints fairly and respond within a reasonable period.

18. Limitation of Liability

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

Subject to that:

Venture Beyond will not be responsible for indirect or consequential losses, loss of business, loss of profits, loss of opportunity or other losses that were not reasonably foreseeable at the time the contract was entered into.

Nothing in these Terms & Conditions affects your statutory rights as a consumer.

19. Events Outside Our Control

We will not be liable for failure or delay in providing a course where this results from circumstances outside our reasonable control.

This may include, for example:

  • extreme weather;
  • natural disasters;
  • serious illness or injury;
  • transport disruption;
  • government restrictions;
  • venue closure;
  • industrial action;
  • infrastructure failure;
  • public emergency; or
  • other circumstances that could not reasonably have been anticipated or prevented.

Where such circumstances affect a course, we will take reasonable steps to minimise disruption and, where possible, offer an alternative date or other appropriate solution.

20. Privacy

Personal information supplied during the booking process will be handled in accordance with our Privacy Policy.

Information may be shared with relevant instructors, venues, awarding bodies or other service providers where reasonably necessary to deliver the course or fulfil accreditation requirements.

21. Changes to These Terms

We may update these Terms & Conditions from time to time.

The Terms & Conditions applicable to your booking will normally be those in force at the time you make your booking, unless a change is required by law or regulatory requirements.

22. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Any dispute will be subject to the jurisdiction of the courts of England and Wales, except where applicable consumer law provides otherwise.
